La Procuración dictaminó que la Corte Suprema es competente en la demanda de la Ciudad por las clases

La Corte Suprema de Justicia recibió hoy la demanda del jefe de Gobierno porteño, Horacio Rodríguez Larreta, para que no se frenen las clases presenciales y lo giró a la Procuración General de la Nación, que dictaminó que sí es competente para intervenir en la causa.

El máximo tribunal del país no le pidió opinión sobre la medida cautelar, sino para ver si corresponde intervenir y así lo confirmó la Procuración, a cargo interinamente de Eduardo Casal.

Si bien el organismo no tenía plazos para emitir su dictamen, lo hizo en tiempo récord: solo tardó unas horas.

La presentación que realizó el jefe de Gobierno porteño ante la Corte Suprema advirtió que las restricciones impuestas por el presidente Alberto Fernández implican “una virtual intervención federal” sobre la Ciudad, así como también afirmó que “la suspensión de las clases presenciales dispuesta no se encuentra justificada en datos empíricos”.

El recurso fue presentado ante el máximo tribunal a las 9:50, es decir diez minutos antes de que se diera inicio a la reunión entre el mandatario nacional y el porteño en la Quinta de Olivos para hablar sobre las diferencias de criterios ante el aumento de casos de coronavirus.

La acción judicial busca que se declare la inconstitucionalidad del Decreto de Necesidad y Urgencia 241/21 del Poder Ejecutivo Nacional, que comenzó a regir este viernes y que dispone la suspensión de las clases presenciales y las actividades educativas no escolares presenciales en todos los niveles y en todas sus modalidades desde el 19 de abril hasta el 30 de abril inclusive, entre otras medidas.

Puntualmente, la medida cautelar es contra el artículo 2 del DNU e incluye a toda otra disposición o reglamentación dictada en su consecuencia: la Ciudad pide que se le ordene al Estado Nacional que “se abstenga, hasta el dictado de la sentencia definitiva y firme, de llevar a cabo cualquier acto que implique poner en ejecución el Decreto cuestionado”.

Al entender del Gobierno porteño, la suspensión de las clases presenciales violan la autonomía de la Ciudad e implica “una virtual intervención federal”, ya que afirma que la Nación “se arroga potestades sobre competencias eminentemente locales, en salud y educación”.

Además, advirtió que “no es razonable, ya que la suspensión de las clases presenciales dispuesta no se encuentra justificada en datos empíricos, y resulta arbitraria porque obedece exclusivamente a la voluntad de quien detenta el Poder Ejecutivo Nacional”.

En ese sentido, la Ciudad aseguró que “por el contrario está científicamente demostrado, en el ámbito internacional y local, que el grado de contagio en establecimientos escolares es mínimo”.

También denunció que el DNU “constituye una clara violación al principio de igualdad porque se evidencia una discriminación arbitraria con relación a las restantes provincias, que pueden decidir respecto de la continuidad o suspensión del ciclo lectivo 2021”.

La presentación de la Ciudad afirma que las restricciones vulneran tratados internacionales de jerarquía constitucional, como la Convención sobre los Derechos del Niño, que consagra el derecho del niño a la educación, como un derecho progresivo que debe ejercerse en condiciones de igualdad.

“Debe garantizarse la efectividad de los derechos de los niños, niñas y adolescentes que concurren a las escuelas públicas de la Ciudad Autónoma de Buenos Aires, a la educación y a la salud, amparados por las normas constitucionales y convencionales”, subrayó Rodríguez Larreta en la cautelar.
