El gobernador Axel Kicillof llegó a un acuerdo con la oposición de Juntos por el Cambio y descongela el frente judicial: Ya firmó el decreto por el cual designa a los primeros 31 jueces, fiscales y defensores desde que asumió el cargo, mientras que en el Senado aprobaron por unanimidad otros 31 pliegos más, por lo que nos nombramientos se duplicarán en poco tiempo.
La designación de funcionarios del poder judicial se había demorado porque había quedado envuelta en una polémica política: Poco antes de las elecciones en la que perdió su reelección –y después de las primarias, en las que ya había sido derrotada- la exgobernadora María Eugenia Vidal envió a la Legislatura 41 pliegos, que no llegaron a tratarse durante su mandato. Después, Juntos por el Cambio impuso su mayoría en la cámara Alta y aprobó las designaciones –todas menos la de Emiliano Jarish, un candidato que había sido procesado-, movimiento que Kicillof contestó retirando los expedientes de la Cámara y negándose a firmar el decreto de designación.
La situación se había mantenido congelada hasta ahora, que un acuerdo político permitió destrabarla. Así, Kicillof pudo firmar el decreto y designar a 31 funcionarios, los primeros de su mandato, que estaban incluidos en aquel listado que mandó Vidal. Fuentes de la gobernación dijeron que el Gobernador -y el ministro de Justicia, Julio Alak- analizaron detalladamente los nombres y definieron quienes pasaron su filtro.
Fuentes del gobierno indicaron que en el proceso, además de Jarish, que ya había sido descartado, se detectó que “una de las personas propuestas por Vidal para cubrir un cargo de agente fiscal en el Departamento Judicial de San Isidro se encontraba detenida sospechada de integrar una red de narcotráfico”.
Entre los nombramientos que efectuó el gobernador hay 11 jueces y juezas de los fueros Crimina, Civil y Comercial, de Familia y uno de garantías, 13 fiscales, y seis defensores y defensoras de los fueros Criminal y Civil y Comercial y una asesora de incapaces.
De esa manera, el gobierno también dio respuesta a un señalamiento de la Suprema Corte de la Provincia, que había señalado, en una acordada muy comentada de finales del año pasado, la necesidad de avanzar con la cobertura de las vacantes que se vienen produciendo en el Poder Judicial bonaerense.
Al mismo tiempo, el acuerdo permitió que en la Comisión de Asuntos Constitucionales y Acuerdos del Senado se avance por unanimidad en la aprobación de otras ternas 31 enviadas el 2 de junio por el gobernador, algunos de los cuales pertenecen al lote de los que había mandado Vidal pero otros fueron elegidos por Kicillof. Así, en breve los nombramientos se duplicarán.
Por ahora, en cambio, no se resolvió la situación de dos de las vacantes más “calientes”: las de la Cámara de Casación. Allí, el Ejecutivo sigue rechazando la designación de Francisco Pont Verges, secretario de Política Criminal del Procurador Julio Conte Grand –una figura que buena parte del Ejecutivo rechaza- al que le reprochan la actuación en una causa contra el fallecido Defensor del Casación, Mario Coriolano.
