De manera coincidente con la casa devorada por el agua en Mar de Ajó días atrás, la Federación Argentina de Agrimensores (FADA) realizará desde este viernes tres jornadas virtuales de “divulgación y debate” sobre línea de ribera y riesgo hídrico, con acceso libre y gratuito, “para poner en valor la necesidad de regular y reglamentar de manera ajustada al interés común la interacción del hombre con los recursos hídricos”.
“Se trata de tres viernes consecutivos de trabajo en los cuales se avanzará en lo que será la IV Jornada Nacional sobre el tema, que estaba prevista realizarse en octubre del año pasado en Santa Fe, más allá de esta azarosa coincidencia con lo que sucedió en la costa bonaerense y también del derrumbe de las barrancas del río Paraná, en Rosario y en la zona de islas, hace poco tiempo”, aclaró el titular de la FADA, Marcelo Lupiano.
“Esperamos que todos los profesionales interesados puedan participar ahora de estos tres ciclos”, agregó Lupiano.
“Existe la necesidad de ordenar territorialmente las costas de los ríos, mares, lagos, arroyos y lagunas, además de acompañar el paso de los ingentes valores monetarios de la tierra en esos sectores y la creciente importancia estratégica del agua que contienen y transportan los cursos que se pretende deslindar, cuestiones que obligaron ya a algunas jurisdicciones provinciales para tomar el tema de la delimitación del dominio público hídrico como una cuestión de Estado y actuar en consecuencia”, explicó el dirigente.
En ese marco, en un comunicado, se explicó que la línea de ribera es un límite territorial, y es aquel que divide el dominio privado del dominio público hídrico; es decir, la línea que divide un río, arroyo, lago, laguna o el mar del territorio continental adyacente. Está definido en el Código Civil y Comercial como el promedio de las máximas crecidas ordinarias y como la más alta marea ordinaria, sin tomar aquellas extraordinarias debidas a tormentas.
Además, desde esa línea se proyectan otras dos, que son las denominadas de riesgo hídrico, o sea franjas paralelas a la costa sobre las cuales, desde los propios estados, se plantean distintas restricciones en función del riesgo hídrico que contienen por su ubicación.
“Para medir el riesgo de una determinada situación se deben tener en cuenta dos factores: uno es la amenaza concreta que produce la misma, por ejemplo inundación, o derrumbe ante crecidas y bajantes extremas, o ante tormentas furiosas, etcétera; y sobre esto es poco lo que el humano puede hacer, más que tomar nota y aprender con la historia de cada caso, ya que la naturaleza es, en la mayoría de esas ocasiones, inmanejable. El otro aspecto es la vulnerabilidad, que es la predisposición o susceptibilidad que una comunidad tiene de recibir un daño si esa amenaza se concreta, y sobre eso sí se puede actuar, y trabajar para mitigar el riesgo”, explicó el presidente de la Federación Argentina de Agrimensores.
“La normativa jurídica debe, entonces, transformarse y evolucionar para responder a las nuevas condiciones dadas en los casos de la instalación definitiva de novedosos usos y costumbres, tratando con ello de arribar a una lógica armonía entre lo anteriormente utilizado y la situación actual”, añadió Lupiano.
“Entonces, muchas veces, quienes pueden y deben llamar la atención sobre esos asuntos, son aquellos cuya formación profesional y consiguiente responsabilidad social los distingue, en este caso para el manejo de la gestión territorial, así como para lograr una correcta administración de los bienes públicos y, en dicho carácter, los obliga a mantenerse atentos, sirviendo de oteadores de la realidad para beneficio de la sociedad que constituyen o representan”, finalizó al presidente de la FADA.
