Tras el rechazo a la media cautelar interpuesta por un grupo de padres autoconvocados que clama por las clases presenciales, ahora desde el mismo juzgado se habilitó la apelación presentada por los demandantes, que será tratada por la Cámara de Apelación en lo Contencioso y Administrativa de Mar del Plata.
Asimismo, se dio traslado de las actuaciones al Asesor de Incapaces, Ezequiel Belaunzarán, dado que en la presentación se invocó derechos de niños y adolescentes.
Como oportunamente se señaló, la jueza de Garantías 2, Stella Maris Aracil, no hizo lugar a la pretensión del grupo de padres tandilenses, señalando entre otras argumentaciones que a la hora de decretar la suspensión de las clases presenciales (previo al confindamiento), la Provincia se tomó de parámetros de evaluación, estratificación y determinación del nivel de riesgo epidemiológico productos de evidencia científica. Mientras que los amparistas alegan que “no hay circulación del virus en el ámbito escolar en el partido de Tandil”, resultaron simples manifestaciones generales, por lo que no se puso en crisis la racionalidad de las resoluciones gubernamentales.
Asimismo, a la hora de cuestionar los decretos nacionales, la jueza consideró que no era de su competencia, más bien del fuero Federal, donde podría recalar la apelación de esta resolución en primera instancia que evaporó las pretensiones del grupo de padres.
Por otro lado, también la magistrada respondió sobre la incidencia colectiva que se arrogaron representar.
Para la jueza, si bien los amparistas resultan ser padres de hijos en edad escolar, respecto de los cuales puede verse afectado el modo en que ha de serles impartida a estos la enseñanza en los establecimientos educativos a los que concurren, resultan otras diversidades posibles entre los integrantes del grupo, que le quita homogeneidad al reclamo.
Para Aracil, “si bien la problemática objeto de la presente acción de amparo tiene una dimensión colectiva y exhibe aspectos que pueden ser comunicables a los miembros del grupo, carece de la envergadura colectiva que se pretende asignar a esta acción. Ello así, toda vez que los accionantes se arrogan la legitimación activa de otro número indeterminado de personas que, en igualdad de situación pueden tener buenas razones para considerar que las medidas sanitarias establecidas por Poder Ejecutivo provincial cuestionadas, y las restricciones y/o limitaciones también impuestas temporariamente de concurrencia de los niños, niñas y adolescentes a los establecimientos educativos, no les provocan una lesión o menoscabo a derecho alguno de raigambre constitucional”.
