La Cámara Federal porteña desprocesó al periodista Daniel Santoro en la causa en la que está acusado de un intento de extorsión, junto con el falso abogado Marcelo D’Alessio, sobre el agente aduanero Gabriel Traficante en la causa conocida como “mafia de los contenedores”.
Los camaristas Eduardo Farah y Roberto Boico coincidieron en que “no concurren todavía los presupuestos básicos necesarios para determinar si Santoro dio un aporte esencial, consciente y voluntario a la maniobra de un tercero” para el intento de extorsión.
Santoro había sido procesado por el juez federal Luis Rodríguez en una causa que se inició en 2016, mucho antes de que estallara el otro expediente por el que D’Alessio está hoy detenido.
“La información hasta ahora conocida no resulta a priori incompatible con la hipótesis de la defensa, según la cual la relación entre Santoro y D´Alessio fue, únicamente, la de una fuente con un periodista que confió en la información que le brindaba”, sostuvo el juez Farah.
No obstante, advirtió que “restan investigarse aspectos centrales para corroborar o descartar tal hipótesis o la contraria. Y ello impide arribar a definiciones con sustento suficiente en este momento”.
Santoro fue beneficiado con una “falta de mérito” porque –según los camaristas- “la evidencia sobre el caso es incompleta y no respalda esa presunción”.
El tercer integrante del tribunal, Martín Irurzun, directamente había propuesto el sobreseimiento definitivo del periodista.
Pero Farah y Boico sostuvieron que no es posible descartar la participación de Santoro en el delito que se le reprocha y, para ello, ordenaron una serie de medidas de prueba para profundizar la investigación.
El tribunal ordenó que se le reciba declaración testimonial al ex abogado de D’Alessio, Rodrigo González, y que “se precise y certifique la existencia o no de comunicaciones y/o mensajes -y su tenor- entre D´Alessio y Santoro desde el 24/11/2016 hasta que finalizó la intimidación a Traficante”.
En el mismo orden, dispuso que “se practiquen todas las medidas dirigidas a corroborar los descargos del imputado, todo lo cual permitirá contar con la información necesaria para reevaluar el caso, resolver el conflicto y proveer en consecuencia una respuesta adecuada a las implicancias constitucionales invocadas por la parte”.
El camarista Boico añadió que “la complejidad del caso no está atravesada por controversia constitucional alguna, y menos aún apalancada en la posible extensión de un derecho de libertad de prensa que se predica menoscabado”.
“La pesquisa no giró en derredor del sometimiento de una opinión periodística a la apreciación de los jueces para censurarla o expiarla, ni se exhiben pretensiones de perturbación o molestia derivada de la difusión de un artículo periodístico, extremos que de apreciarse concitarían una cuestión de tal estirpe”, subrayó el magistrado.
“Muy por el contrario, el presente litigio transita por la verificación de presuntos aportes que un sujeto, de profesión periodista, habría realizado bajo un previo concierto criminal orientado a la extorsión de un tercero, y cuyas contribuciones, según la tesis que alberga la acusación, estarían reflejadas en notas periodísticas publicadas en medios gráficos de difusión masiva con tal propósito”, aclaró.
Según el juez que definió la votación, “lo hasta aquí incorporado al legajo no resulta suficiente de momento para afirmar – al menos con el grado de probabilidad que esta etapa del trámite exige – un actuar coordinado y concertado de Santoro con D´Alessio y los otros participantes del hecho”.
No obstante, insistió, “hay conjeturas razonables que, desde un plano objetivo, respaldan las sospechas albergadas por el juez”, por lo que es necesario profundizar la investigación.
