Las personas que se encuentren en aislamiento por contagio confirmado de Covid-19 o que tengan síntomas compatibles con esa enfermedad (aunque no tengan hisopado que lo determine, es decir casos sospechosos), quienes sean contactos estrechos o quienes integren grupos de riesgo estarán autorizadas legalmente para no votar en las elecciones de este año.
La misma excepción se aplicará para quienes integren grupos de riesgo que por indicación médica deban evitar los lugares con movimiento de gente, según determinó la Cámara Nacional Electoral (CNE) en el artículo 11 de la acordada 83, en el que estableció un “protocolo sanitario” para la realización de los comicios en este contexto de pandemia.
No obstante, la CNE estableció que para el caso de las personas que pese a estar comprendidas en la justificación para no votar quieran ejercer de todas formas su derecho a sufragar, entonces el juez electoral del distrito que corresponda deberá “determinar el procedimiento de emisión del voto”.
Estas decisiones fueron adoptadas por la Justicia Electoral y regirán para las elecciones primarias abiertas, simultáneas y obligatorias (PASO) del 12 de septiembre y para las generales del 14 de noviembre, la primera convocatoria a las urnas que en la Argentina se realizará en el marco de la pandemia para elegir 24 senadores y 127 diputados.
En este marco, la CNE dispuso que en caso de que un ciudadano “exija ejercer su derecho al sufragio” a pesar de estar en aislamiento por contagio confirmado o sospechoso de Covid-19, el juez federal electoral del distrito “determinará el procedimiento de emisión de voto”, para lo cual “deberá garantizar las medidas de higiene y distanciamiento adecuadas” para “garantizar la salud de las demás personas”.
Así lo establece la acordada extraordinaria 83 de la Cámara Electoral, emitida el martes pasado tras haber sido votada por el presidente, Santiago Corcuera, y los otros dos camaristas, Daniel Bejas y Alberto Dalla Vía, y que en su artículo 11 contiene el “Protocolo sanitario contra el Covid-19”.
En cuanto a los ciudadanos que tengan un PCR positivo confirmado, síntomas compatibles con Covid o hayan estado en contacto estrecho con alguien cursando la enfermedad y que, por lo tanto, no quieran sufragar, podrán tramitar el justificativo de no emisión del voto a través del portal web de la Cámara, en la sección de infracciones al acto electoral.
La acordada extraordinaria 83 se emitió tras realizar consultas con los ministerios de Salud y de Interior, como también con los jueces electorales de las 24 jurisdicciones del país, y además se tuvieron en cuenta otros procesos electorales realizados en la región tras la irrupción planetaria del coronavirus.
