Juan Facundo Gómez Urso y Pablo Viñas fueron acusados por “negligencia e inclumplimiento del cargo” luego de absolver a tres personas acusadas de abusar sexualmente y matar a la adolescente de 16 años.
La acusación recayó sobre los magistrados Juan Facundo Gómez Urso y Pablo Viñas, integrantes del Tribunal Oral en lo Criminal (TOC) 1 marplatense, quienes son investigados por su fallo de noviembre del 2018 en el que absolvieron a Matías Farías (26), Juan Pablo Offidani (45) y Alejandro Maciel (62).
Tras ser revertidas esas absoluciones en agosto de 2020 por el Tribunal de Casación bonaerense, esos dos jueces (el tercero, Aldo Carnevale, renunció para jubilarse) fueron denunciados y se constituyó un jury de enjuiciamiento, tras lo cual se dio traslado a la Procuración y a la Bicameral.
“La Procuración ya acusó y hoy lo hizo la Bicameral”, dijo a Télam una fuente judicial, que agregó que “ahora se dará traslado a los magistrados para que hagan uso de su derecho a defensa y, luego, se tratará la admisibilidad de la acusación; es decir si se dispone o no la suspensión de los magistrados mientras avanza el debate”.
Según determinaron los investigadores, el hecho ocurrió el 8 de octubre de 2016 a las 10.30, cuando Offidani y Farías, quienes vendían drogas a adolescentes cerca de escuelas de Mar del Plata, llevaron a Lucía (16) hasta una vivienda donde abusaron sexualmente de ella, tras lo cual, la trasladaron muerta hasta un centro médico alejado de esa ciudad.
No obstante, durante el debate oral, los jueces consideraron que no se pudo probar cuál fue la causa de la muerte de Lucía ni que haya sido abusada, por lo que absolvió a los tres acusados de esos delitos.
Solo condenaron a ocho años de prisión a Farías y a Offidani por “tenencia de estupefacientes con fines de comercialización agravado por ser en perjuicio de menores de edad y en inmediaciones de un establecimiento educativo”.
En la acusación de la Bicameral, a la que accedió Télam, se indicó que “la queja se relaciona con la resolución de libre absolución que beneficiara en el juicio oral a los autores de los delitos, por el gravísimo delito de abuso sexual, con acceso carnal, agravado por haber causado la muerte de la ofendida y habiendo sido favorecido por el suministro de estupefacientes”.
“Dan cuenta las denuncias de manera concordante que la niña fue drogada, abusada sexualmente y asesinada, por lo que la sentencia dictada lejos de ajustarse a derecho evidencia una clara arbitrariedad, que deja impune el femicidio, de lo que demuestra con supina claridad la incompetencia e incumplimiento a los deberes del cargo de los juzgadores”, señalaron los acusadores.
También consideraron que “se advierte que no existió justificación alguna para negar que en el suceso se hubiera producido un abuso sexual respecto de la menor, con los agravantes ya enunciados”.
“Por ello, la falta de establecer la consecuente responsabilidad de los acusados, aun reconociendo que Lucía murió en la casa, ello ocurrió mientras mantenía relaciones sexuales, debido a la asfixia tóxica producida por el consumo de cocaína que le proporcionaron y por la posesión por la que fueron condenados”, continuaron.
Para la Bicameral “debió contemplarse que la dependencia le impedía a la niña dirigir su voluntad” y recordó que “se consignó en la sentencia que hasta cambiaba droga por sexo, que no podía ser fácilmente sometida y que no existió una relación de subordinación por mantener relaciones no consentidas”.
Según la acusación, los jueces “negaron una situación de vulnerabilidad dentro del contexto de género y que fuera cosificada para satisfacer sus deseos”.
En el informe se cuestionó, además, que el TOC 1 se enfocó en “indagar en la personalidad, actitudes y comportamientos anteriores de la víctima, como su forma de relacionarse con los hombres, su vida social, su carácter y en distinguir la conducta de los imputados y a partir de allí, considerar si Lucía había consentido el acceso carnal”.
“Hicieron hincapié en la muerte tóxica que los peritos dieron como la causa más probable del deceso y la ausencia de lesiones, de un coito brusco o impetuoso. Para los enjuiciados fue todo normal y natural, querido y consentido, citando el paradigma de la mujer honesta”, añadieron.
Por otra parte, a partir del fallo de Casación que anuló la sentencia de primera instancia, se espera que se sortee un nuevo tribunal marplatense, que no puede ser el TOC 1, para realizar un nuevo debate oral.
En octubre del año pasado, al cumplirse el cuarto aniversario del femicidio, Marta Montero, madre de Lucía, pidió que este segundo juicio “se realice cuanto antes y sea lo más ágil posible”, aunque ya no estarán los tres imputados, ya que Maciel falleció en julio del año pasado por una enfermedad.
