Desde que entró en vigencia la ley de aborto fueron presentados al menos 29 pedidos de inconsitucionalidad de IVE: 18 fueron rechazados y los demás están en trámite (Foto/Nicolás Stulberg)
El domingo 24 de enero de 2021 entró en vigencia la Ley 27.610 de Acceso a la Interrupción Voluntaria del Embarazo (IVE). A partir de esa fecha, y tras años de un reclamo histórico encabezado por el feminismo, Argentina pasó a integrar oficialmente la lista de países donde el aborto es legal.
Sin embargo, este lunes 7 de junio, el juez federal Alfredo Eugenio López, titular del Juzgado Federal N° 4 de Mar del Plata, hizo lugar a una medida cautelar presentada por el abogado Héctor Adolfo Seri, ex candidato del partido de Aldo Rico y vinculado a la Iglesia Católica, y ordenó suspender la Ley 27.610 de interrupción voluntaria del embarazo por considerar que “viola la obligación internacional del Estado argentino de proteger la vida desde la concepción” y por “poner en juego el derecho de la vida de niños por nacer”.
En su sentencia López se ocupó de remarcar que su “condición de católico y respetuoso de la vida humana no resulta óbice para la intervención” en el caso y le pidió al Estado Nacional la suspensión no solo de la normativa, sino también de todos los protocolos y resoluciones relacionadas “hasta tanto se resuelva la cuestión de fondo”, es decir, si la ley es inconstitucional o no, como planteó Seri, en su escrito en contra de la IVE.
Los argumentos del magistrado lo llevaron a recordar una sentencia de la Corte Suprema de hace 40 años, que sostenía que “la vida es el primer derecho de la persona humana que resulta reconocido y garantizado por la Constitución Nacional”. Lejos de estar relacionado con el aborto, aquel fallo, con fecha del 6 noviembre de 1980, hacía referencia al pedido de unos padres para que se autorizara el trasplante de un riñón de una hija menor a otro hijo de la pareja.
También hizo mención al fallo reciente de la Cámara de Apelaciones de la Justicia de San Juan, que ordenó a una mujer que se abstenga de practicar la interrupción del embarazo que estaba transitando; así como la decisión de una jueza de la ciudad de Resistencia (Chaco) que ordenó suspender la vigencia de la ley 27.610, pero que fue revocada.
Desde que entró en vigencia la ley de aborto, según recopiló Página/12, fueron presentados al menos 29 pedidos de inconsitucionalidad de IVE en diferentes provincias y distintos fueros (federal y provincial): 18 fueron rechazados y los demás están en trámite.
López sostuvo, además, que la medida cautelar era procedente en tanto la sanción de la Ley N°27.610 y el Protocolo para la atención integral de las personas con derecho a la interrupción legal del embarazo “afectan y ponen en peligro la vida, dignidad y derecho del niño por nacer, como de su madre gestante”.
De esa forma, concluyó que se encuentran en riesgo el derecho a la vida reconocido en la Constitución Nacional, en la Convención Internacional de los Derechos del Niño y de la Convención Americana de Derechos Humanos.
Asimismo, señaló que el peligro en la demora se ve cumplido en tanto “un número imponderable de niñas y niños por nacer pueden sufrir su muerte desde este mismo momento y la sentencia definitiva que se dicte en la presente acción no podrá remediar su situación en virtud del tiempo transcurrido en la sustanciación del caso de autos”.
En definitiva, el magistrado ordenó la suspensión cautelar tanto de la Ley N°27.610 de Interrupción Voluntaria del Embarazo como del “Protocolo para la atención integral de las personas con derecho a la interrupción legal del embarazo”, aprobado a fines de 2019 por el Poder Ejecutivo Nacional.
En lo siguiente, la acción de amparo continuará con los informes que deberá presentar el Estado Nacional, solicitados con posterioridad al dictado de la cautelar.
Luego de que se conociera este fallo, la sede marplatense de la Campaña por el Derecho al Aborto Legal, Seguro y Gratuito emitió un comunicado en el que repudió la decisión del magistrado y remarcó que “los abortos se van a seguir realizando dentro y fuera del sistema de salud”.
“El debate nacional está saldado. La democracia, por medio de las instituciones correspondientes, analizó la cuestión y resolvió una ley que contó con el análisis pormenorizado de aspectos sanitarios y constitucionales. No sorprende que sectores minoritarios antidemocráticos quieran obturar el acceso a derechos sexuales y reproductivos, valiéndose de alianzas misóginas”, lamentó la agrupación.
En este sentido, la organización señaló que confía “en la celeridad del Estado Nacional en la presentación de la apelación” correspondiente y que espera también “una nueva resolución respetuosa de los estándares nacionales e internacionales en materia de derechos humanos”.
